Free Warranty Promotion Terms & Conditions

These terms and conditions (the “Terms”) apply to Carmoola Limited’s (“Carmoola”, “we”, “us”, or “our”) promotional offer of a free vehicle warranty and breakdown cover (the “Free Warranty Cover”) to selected customers who enter into a finance agreement with us.

1. Promotion Overview and Eligibility

1.1 From time to time, Carmoola may offer eligible customers a free vehicle warranty as part of a promotional campaign. This Free Warranty Cover is funded by Carmoola but administered and provided by Warrantywise UK Limited (“Warrantywise”), whose registered office is at 3 Trident Way, Trident Park, Blackburn, Lancashire, BB1 3NU.

1.2 You are only eligible to receive this promotion if a warranty offer is explicitly presented to you in the Carmoola app as part of your application journey. Not all customers will be eligible. This promotion may not be available to all users, and eligibility is determined at our sole discretion, based on randomised or other criteria. As part of our ongoing testing and optimisation efforts, we may present different offers to different users.

1.3 If your application expires, is withdrawn, or is declined, you will not be entitled to receive the Free Warranty Cover for that application. You are not guaranteed to be offered Free Warranty Cover in future applications. A warranty offer does not guarantee, indicate or influence whether you will be approved for a loan.

1.4 The offer is only valid during the period of the application in which it is presented, for a maximum of 30 days. If that application expires or is restarted, the offer may no longer be available. The promotion is not guaranteed to be available in future applications.

1.5 We reserve the right to vary, suspend or withdraw this promotion at any time and without notice.

 

2. Warranty Activation

2.1 The Free Warranty Cover will only be activated once your loan agreement with Carmoola has been completed and the funds have been disbursed to the dealer or, in the case of refinance, other finance company. The start date of the warranty will be the date your loan is originated.

2.2 Your specific warranty schedule (the “Plan Schedule”) and full terms and conditions (the “Plan”) will be issued by Carmoola on behalf of Warrantywise, and will be sent to you by email at the point the plan is active. They will also be available to view in the Carmoola app. You should read these documents carefully and ensure you understand what is and is not included, and whether the cover is suitable for your needs.

2.3 The warranty is non-transferable, non-refundable, and cannot be exchanged for cash or other benefits. It is only valid for the specific vehicle linked to your finance agreement.

 

3. Nature of the Warranty Product

3.1 The Free Warranty Cover provided under this promotion is not a regulated financial product. It does not fall within the scope of supervision by the Financial Conduct Authority (FCA).

3.2 The warranty is not a contract of insurance and does not offer the protections associated with regulated insurance products. It is not covered by the Financial Ombudsman Service or the Financial Services Compensation Scheme.

3.3 Your contract for the provision of the warranty will be with Warrantywise. Carmoola is not responsible for the fulfilment, administration, or service quality of the warranty.

3.4 The warranty is not a condition of your loan and does not affect the terms of your finance agreement. It does not form part of your interest rate, is not linked to the cost of credit, and is not a linked transaction under consumer credit regulations.

 

4. Assignment of Rights

4.1 By accepting the Free Warranty Cover funded by Carmoola, you agree to irrevocably assign certain limited rights under the Plan to us. This includes the right to cancel the Plan under the circumstances set out in these Terms and to receive any refund or rebate payable by Warrantywise in the event of cancellation.

4.2 These assigned rights allow us to manage the cancellation of the Plan and to recover any unused value if applicable. These rights do not affect your ability to access the benefits of the cover while it remains in place.

 

5. Cancellation of Warranty Cover

5.1 The Free Warranty Cover will be cancelled in the following circumstances:

  • Your loan is undone;
  • Your loan is voluntarily terminated;
  • You do not retain possession of the vehicle for any reason;
  • The vehicle is sold, voluntarily surrendered, repossessed, written off, or rejected to Carmoola under statutory rights;
  • Your application or loan is found to be fraudulent;
  • Carmoola determines, at its sole discretion, that the Free Warranty Cover is being misused, including but not limited to non-personal use, commercial activity, or any other inappropriate or abusive conduct.

5.2 If the Plan is cancelled and a rebate is issued by Warrantywise, Carmoola will be the beneficiary of that rebate.

5.3 For the avoidance of doubt, subject to clause 5.1, the Free Warranty Cover will not be cancelled during the Plan period where:

  • You repay your loan in full early;
  • You withdraw from your loan agreement within the statutory 14-day period;
  • You retain possession of the vehicle and continue to meet your obligations under the loan agreement.

5.4 If you wish to extend the duration of your warranty or upgrade the level of cover, this must be arranged directly with Warrantywise and will be at your own expense. Warrantywise is under no obligation to offer extended or upgraded cover, and any such changes will be at their sole discretion. If you contribute additional funds towards enhanced cover, you may be entitled to a rebate in the event of cancellation; however, any pro-rated rebate will apply only to the portion of the cover that you have personally paid for.

 

6. Your Responsibilities

6.1 You are responsible for ensuring that your contact and vehicle details remain accurate and up to date with Warrantywise for the duration of the cover.

6.2 Any attempt to misuse or make fraudulent claims under the warranty will result in cancellation of the cover and may lead to legal action by Warrantywise. Carmoola is not responsible for investigating or becoming involved in any disputes relating to fraudulent activity.

 

7. Complaints and Disputes

7.1 All complaints relating to the warranty product itself must be directed to Warrantywise in accordance with their complaints procedure. You can find out more at https://www.warrantywise.co.uk/complaints/

7.2 If you are not satisfied with a decision made by Warrantywise, you may appeal through their independent arbitrator, Edd China, who will review your case and make a final decision at his sole discretion. Warrantywise staff will abide by his decision.

7.3 Should you remain dissatisfied with the outcome of arbitration, you acknowledge that Carmoola will not support or participate in any further legal proceedings in relation to the warranty.

7.4 Any complaints specifically relating to the offer or promotion of this Free Warranty Cover by Carmoola should be directed to us at complaints@carmoola.co.uk.

 

8. Data Protection

8.1 In order to arrange the Free Warranty Cover, Carmoola will share certain personal information with Warrantywise. This will include only the data necessary for the creation and administration of your warranty.

8.2 Warrantywise will act as an independent data controller for the personal data it receives. You should refer to Warrantywise’s privacy policy for details on how your data is processed.

 

9. Borrow Responsibly

9.1 While the warranty may be offered at no cost, you should always consider whether borrowing is affordable for your circumstances. Taking out credit is a serious financial commitment, and you should ensure you are able to make all payments on time and in full.

 

10. General Terms

10.1 Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10.2 Entire Agreement
These Terms constitute the entire agreement between you and Carmoola in relation to the promotional Free Warranty Cover and supersede any prior agreements, communications or representations, whether written or oral.

10.3 Rights of Third Parties
No third party shall have any rights to enforce any of these Terms under the Contracts (Rights of Third Parties) Act 1999.

10.4 Changes to Terms
We may update or amend these Terms from time to time. Any changes will be communicated via email, the Carmoola app or website. Your continued use of our services constitutes acceptance of the updated Terms.
